1.  ACKNOWLEDGMENT AND ACCEPTANCE OF TERMS & CONDITIONS

The following Terms & Conditions govern your use of the Scattermats Rug Warehouse Website ("Website") located at www.scattermats.com.au and the materials and information accessible on or from the Website.  The Website is only available for use by persons over the age of 18 years and of an age to legally enter into binding agreements.

Your use of the Website means you accept these terms and conditions. If you do not accept these terms and conditions, please do not use or visit the Website.

The following Terms & Conditions apply to any purchases made in-store at Scattermats Rug Warehouse located at Unit 6, 40 Port Pirie Street, Bibra Lake, Western Australia 6163.

2.  WEBSITE ORDERS & DELIVERIES

Free Shipping *, this (*) asterix after the wording of Free Shipping denotes that orders above the amount of $150 are entitled to free shipping but is subject to conditions mentioned below.

Free shipping Australia Wide or the $20 set fee, may be insufficient to cover the Scattermats standard shipping allowance, this can be due to but not limited to the courier companies costs of delivery to regional, remote, un-frequented locations or extra large item costs for delivery. Scattermats will notify the customer by email or phone if any extra charges apply, the customer then may elect to cancel the order and will receive a full refund of any monies already paid.

All orders placed through the website are subject to confirmation and acceptance by Scattermats Rug Warehouse.

All orders are accepted on the condition that you accept these Terms & Conditions. Scattermats Rug Warehouse may revise any of its policies from time to time without notice.

Where the goods are not available at time of order, you will be notified by Scattermats Rug Warehouse as soon as possible, if we unable to aquire the goods, a full refund will be given.

Scattermats Rug Warehouse aims to include up-to-date pictures of all of the products for sale on the website. However, our picture may differ slightly from the goods delivered, due to many reasons such as computer screen settings and difficulty of capturing the correct image colours on camera.

Scattermats Rug Warehouse will deliver the goods you order to the address you specify in your order, approximately within the agreed time frame, subject to their availability and courier reliability.

Any persons at the delivery address who receives the goods will be presumed by Scattermats Rug Warehouse to be authorized to receive the goods.  If there is no-one at the delivery address or no-one of appropriate age to receive the goods, Scattermats Rug Warehouse may charge you additional delivery fees, if you have requested special if no one is home delivery instructions in your order for leaving at door etc. then Scattermats can not cover you for insurance if the product is not there when you arrive home.

Once the goods are delivered to your specified delivery address, you will own them and it is your responsibility if they are lost or damaged.  Please ensure that you inspect the packaging of goods for damage before signing the delivery docket.  If damaged, please state that on the couriers copy of the delivery docket and notify us immediately, Note that as the courier companies employed for shipping are not connected with Scattermats, Scattermats accepts no responsibility for courier mishaps unless items are covered by insurance (shipping costs are not covered by insurance).


3.  WEBSITE PRICES & PAYMENT

For each online order, you must pay:

       * The applicable price for the relevant goods confirmed by Scattermats Rug Warehouse and/or
       * The delivery and handling fee specified on the website at the time, or confirmed at a later date.
       * Payment must be cleared before the goods are dispatched.  All payments are to be made through the payment system provided by the website, unless otherwise agreed.
    We are unable to accept COD payments.

Prices and availability are subject to change without notice.  Typographical, product description, pricing, images and other errors are subject to corrections, even after orders and/or payment are accepted.

Scattermats Rug Warehouse may vary prices in the event of price changes or mistakes made by suppliers on reasonable prior notice to you.  If Scattermats Rug Warehouse requests payment for the increased prices, you may cancel the order by giving notice to Scattermats Rug Warehouse, which must be received within 7 days of the announcement of the increase, and/or before dispatch of the goods.

3 a. Layby Terms & Conditions

  1. Scattermats accept lay-bys on goods, ask our store staff if the product you are interested in is available for lay-by. This means the goods are set aside for you after you have agreed to the terms of our lay-by policy (unless it is a special order in, see clause 3b). You will pay a deposit and agree to pay the balance of the purchase price over a number of instalments (usually 2 or more). Instalments can be accepted weekly, fortnightly or monthly as long as the final payment is paid no longer than 60 days from the date of the deposit.
  2. Only goods with a value of more than $50.00 can be placed on lay-by, with a minimum deposit of 20% of the value of the item or $20.00, whichever is greater, must be paid as a deposit.
  3. Lay-By payments can be made at the store where the goods are held or online through our website, if through the website, payments can only be made by the direct deposit payment option due to website limitations.
  4. One lay-by agreement per customer at any one time, the lay-by must be paid in full before any goods can be taken.
  5. Where a lay-by purchase includes more than one item, the items cannot be separated.
  6. Unless authorised by the store manager, failure to pay the instalments on time and in full means you have broken the lay-by arrangement and the goods will be returned to stock in the store or supplier.
  7. We can only terminate the arrangement if you fail to pay the instalments within the agreed time. If the lay-by agreement is terminated, all money paid by you, except for the set up fee will be refunded but you must pay a $25.00 termination fee.
  8. If the product you have chosen to layby is not in Scattermats showroom floor stock, we will email you the terms & conditions for this special type of layby for you to agree to before Scattermats can accept the layby, see clause 3b.
  9. Please talk to our staff if you have any questions about the process.
  10. Customers must be 18 years old to purchase on lay-by.

        3 b. For special layby orders of products not held in Scattermats store, the items may have to be shipped from one of our supplier to us which incurs a shipping fee, therefore, in the circumstance of any cancellation of this type of layby, any shipping fee inward & outward and any restocking fee (charged by the supplier) for return of the item to the supplier will be deducted from the monies already paid by the customer plus Scattermats $25 termination fee.


4.  REFUNDS/ EXCHANGES

Scattermats Rug Warehouse must be notified by means of email immediately for any of the following.

Goods purchased on the website that are unsuitable, can be exchanged for an item of equivalent value or pay extra for any items of greater value or your account can be left in credit, however they must be free of any dust, dirt, human or animal hair etc.and providing that the product/s is returned to us undamaged and in its original condition and packaging or suitably wrapped and labelled. If the goods have to be cleaned, funds to the amount of $60.00 but no limited to, will be deducted from your amount already paid and or the rug exchange may be rejected and any costs of goods to be returned will be at the purchasers expense. No refunds will be given for any purchases purchased on the website.

If incorrect products have been sent to you, you must notify us of the error immediately after accepting the delivery. The goods need to be returned in it's original packaging and condition, we will arrange for the incorrect goods to be returned to us at no charge to you. The correct goods will be dispatched as soon as we have received the original rug back with no extra postage charges incurred by the buyer.

If you decide to return your item then we'll credit your Scattermats account the purchase price, less delivery fees (to cover the outward and or inbound delivery costs or, to cover re-delivery costs) and any associated administration fees or restocking fees. Any goods being returned, Scattermats may or may not arrange the freight return, but costs will be at customers expense, and, no responsibility will be held by Scattermats for the item being returned. Simply return the item in "as purchased condition" within 48 hours of receiving the product.

Refunds are only given when goods are purchased in person from the showroom in Bibra Lake, and are only refundable within 24 hours of purchase, however they must be free of any dust, dirt, human or animal hair etc.and providing that the product / s is returned to us undamaged and in its original condition and has no evidence of use. If the goods have to be cleaned, funds to the amount of $60.00 but not limited to, will be deducted from your amount paid and or the rug refund / exchange may be rejected.

On receipt of goods, goods found to be faulty by manufacturing may be replaced and/or discounted at Scattermats Rug Warehouse discretion, but only when proof is forwarded by means of photograph for damaged items and/or rug has been returned for manufacture faults visual determination by Scattermats or Supplier's representative.

Any items being unable to be delivered by courier, due to no person to receive goods or decide to cancel or reject the order prior to delivery, will be refunded their purchase price less delivery fees (to cover the outward and or inbound delivery costs or, to cover re-delivery costs) and any associated administration fees or restocking fees determined by Scattermats.

Any product purchased off the roll or has been modified in any way, cannot be refunded or exchanged. This applies to purchases online or in-store.


5.  GST

GST will be included within the prices and fees charged by Scattermats Rug Warehouse and is payable by you at the same time as you pay such prices and fees.  All prices quoted include GST.


6.  WEBSITE FRAUD

Scattermats Rug Warehouse is committed to reducing fraud.  Our policy is that we will prosecute any cases of fraud that we identify.  Should any transaction be completed on the website or in-store using a stolen credit card or by means of a fraudulent manner in any way we will co-operate with the relevant authorities to prosecute the offender. We may require "Proof of Identity" for certain transactions and we may reject any order at our discretion, remember this is for your protection and ours to help combat Internet Fraud.


7.  DISCLOSURE OF PERSONAL INFORMATION

Scattermats Rug Warehouse will take all reasonable efforts to ensure that information concerning your personal information and any other data that you transmit through the website is kept secure.  However, you store this information at your own risk, and Scattermats Rug Warehouse will not be liable for any unauthorized access to, or loss of that information.

We wont disclose any personal information to other parties other than for our own marketing purposes.


 8.   DOWNLOADING OF DOCUMENTS

Scattermats Rug Warehouse will take all reasonable efforts to ensure that files that you download from this website are free from viruses, worms, Trojan horses and other material of a destructive nature, your access to or use of them is at your own risk.


9.   VARIATION OF THESE TERMS & CONDITIONS

Scattermats Rug Warehouse may change these terms & conditions from time to time.  Any changes will be posted on the website.  You are responsible for reviewing the website to ensure compliance with these Terms & Conditions (as varied from time to time).

10. Layby

11. Scattermats Warranty

Scattermats Rug Warehouse will gladly replace a rug / product purchased from our Bibra Lake store within 12 months of the purchase date that is deemed to be “faulty” by Scattermats Rug Warehouse & or the Product Manufacturer. Simply contact Scattermats regarding the faulty product and we will determine if it is covered under our full warranty or pro-rata warranty. Returning of the product back to Scattermats or back to you may be at your own expense.

Conditions:

  • Proof of Purchase – Scattermats Rug Warehouse Receipt with date of purchase or bank statement.
  • Pro Rata waranty- This means exchange or replacement value is taken into consideration depending on how long you have the product for (this is because you have had a certain amount of use already from the product).
  • “Faulty” relates to manufacturing faults as determined by Scattermats Rug Warehouse.
  • “Faulty” does not apply to; stains, fading, watermarking, where product has shrunk or stretched due to water damage, flattening of pile, reasonable fluffing, pilling or shedding, damage to over locking, rugs exposed to sunlight, rugs used in a commercial area, curling or bubbling.
  • Replace means of an equivalent value of purchase price, replace does not equate to a refund.
  • Scattermats Rug Warehouse reserves the right to repair a rug or product at its discretion.
  • Warranty does not apply to bath mats and carpet remnants.
  • Warranty does not apply to Scattermats Rug Warehouse over locking service.
  • Warranty does not apply to rugs or product damaged by cleaning or by being cleaned with incorrect or inappropriate cleaners.
  • Warranty does not cover a rug or product that has been modified in any way.
  • Warranty does not cover lack of care, poor maintenance, accidental damage or tampering to the product.
